社会公共利益视角下的共享单车乱象及应对措施

Chaos of Shared Bicycles from a Perspective of Social Public Interest and Its Coping Strategies

摘要: 社会公共利益在我国法律立法目的中均有所体现。从法律的角度来看,共享单车的出现,能在一定程度上解决交通拥堵问题和空气污染问题,从而维护社会公共利益。但共享单车乱象以及共享单车市场缺乏监管,严重损害了社会公共利益。政府机关出台相应的监管政策,加强政府机关以及企业对共享单车市场的监管,鼓励社会人员参与到监管,将有利于共享单车发挥其积极作用。

Abstract: The social public interest is shown in the purpose of the legislation of Chinese laws. From the legal perspec-
tive, the appearance of the shared bicycles can help to solve some problems of traffic jams and air pollution, and then maintain the social public interest to some degree. Nevertheless, the chaos of the shared bicycles and the lack of supervision in bicycle market have done great harm to the social public interest. The relevant supervision policies made by the government, enhance-
ment of the government’s and enterprises’ supervision over the shared bicycle market, encouragement of the social people’s participation in such supervision, all these can help the shared bicycles to play their active roles.
