署名权侵权行为的界定———以自传体作品和网络环境下署名权侵权行为为例

摘要:署名权作为作者表明身份的权利,旨在区分作品来源,是作者最重要的著作人身权。 现实生活中存在着诸多署名权的侵权行为,其中,对于自传体作品署名权侵权行为以及网络环境下署名权侵权行为的界定,学界存有较大的争议,在司法实践中亦缺乏统一的裁判标准。 对于自传体作品,唯有明确真正的著作权人才能界定对应的侵权行为;位于网络环境下,要在保持作品独立性的基础上对侵权行为进行区分。 明确署名权侵权行为的界限,有针对性的打击不同类型的侵权行为,有助于警示潜在的侵权人,维护著作权管理秩序的稳定。Abstract:As an expression of the author’s identity, the signature right is aimed at distinguishing the source of works,
and is the author’s most important copy-related personal right. In actual life, there exist a lot of infringements against such right, among which there is a controversy in the academic circle concerning the definition of the tort of signature right against autobiographical works and under the network environment. For the autobiographical works, only when we know the real au- thorship can we define the corresponding tort. And under the network environment, we should distinguish the infringements on the basis of keeping the works’ independence. It is of great help for warning the potential infringers and stabilizing the manage- ment of the copyright to know the boundary of infringement of signature right and attack various tort behaviors.
