数字赋能基层综合行政执法改革的问题与出路——以浙江省“大综合一体化”模式为例

Problems and Approaches to Empowering the Reform for the Law Enforcement of Comprehensive Administration in a Primary Level with Digital Technologies

  • 摘要:建设数字法治政府是新时代的一项重要任务,而数字赋能基层综合行政执法改革是数字法治政府建设的重点和难点。浙江省是全国第一个也是唯一的“大综合一体化”综合行政执法改革试点省份,对其基层综合行政执法的数字赋能实践进行实证考察具有代表意义。我国数字赋能基层综合行政执法改革实践中存在诸多问题,主要表现为地方立法保障不足、个人信息安全隐患加剧和对数字执法中算法的制约缺位。未来数字赋能基层综合行政执法改革应从三方面进行重点推进。第一,发挥地方立法保障作用;第二,重视对个人信息的保护,引入个人信息保护独立监管机构,合理限缩行政处罚决定公开之范围;第三,加强对数字执法中算法的治理,公开算法记录,解释算法规则,以及厘清算法责任配置。

    Abstract:Building a digital government ruled by law is an important task in the new era. Empowering the reform for the law enforcement of comprehensive administration in a primary level with digital technologies is a key and challenging aspect of constructing a digital government ruled by law. Zhejiang Province is the first and only pilot province in China for the comprehensive integration reform for the law enforcement of comprehensive administration. Therefore, it is of representative significance to conduct empirical research on the practice of digital empowerment of the law enforcement of comprehensive administration in a primary level in Zhejiang Province. There are several issues in the practice of digital empowerment in the reform for the law enforcement of comprehensive administration in a primary level in China. Specifically, there is insufficient guarantee of local legislation, an exacerbation of security risks of personal information, and a lack of superintendence on algorithms in digital law enforcement. In the future, the digital empowerment reform for the law enforcement of comprehensive administration in a primary level should focus on three key areas. Firstly, the role of guarantee of local legislation should be fulfilled. Secondly, the protection of personal information should be prioritized by introducing an independent regulatory body for protecting personal information and appropriately restricting the scope of public disclosure of decisions of administrative penalty. Thirdly, the governance of algorithms in digital law enforcement with digital technologies should be strengthened by making algorithm records public, explaining algorithm rules, and clarifying the allocation of algorithmic responsibilities.
