The Function, Position and Risk Regulation of Big Data Investigation
Abstract
Big data investigation, through the collection, analysis, and processing of data, can assist agencies of law enforcement in solving cases and predicting crimes. More importantly, it has the work aforementioned done conveniently and efficiently. However, big data in practical applications carry risks which could stem from deficiencies related to information and technology. It may also disadvantage the accused individuals. Even worse, it could infringe upon citizens’ basic rights. To regulate these risks, it is necessary to clarify the operating mechanisms of big data, standardize technologies of information collection and algorithm. A right protection system should be also established, which is targeted at the right to defense and the right of personal information.
