Legal Risks of Generative Artificial Intelligence and Their Regulations
Abstract
The emergence of generative artificial intelligence has optimized industrial structures and speeded up economic development. However, the disruptive breakthroughs in artificial intelligence (AI) technology have also brought about numerous legal risks, which make challenges to legal regulations. Throughout the content generation process, generative AI entails risks such as data compliance, privacy protection, technological monopolies, and intellectual property infringements. Therefore, it is crucial to prevent the escalation of these risks by adherence to risk prevention and proportionality principles, along with compliance with relevant ethical guidelines. Furthermore, it is also indispensable to have specialized laws for AI governance, sandbox regulations. Meanwhile, coordination and agency are enhanced, and autonomous mechanisms are stablished. As a result, risks and challenges can be better addressed, and the sound development of generative AI is achieved.
