On the Roman Legal Foundation of Doctrine of Liability Fixation of Contemporary Tort Laws

  • The contemporary tort theories and legislation can be traced back to Roman laws in which the infringement as the cause of debt is universally accepted. And the application of doctrine of liability fixation has laid the theoretical foundation of contemporary tort laws. From the responsibility for result to the liability for wrongs and then to strict and equitable liability, there exists vast space for application in Roman laws. The doctrine of liability fixation in Roman laws has directly influenced the natures and status of contemporary tort laws. And it has led to the construction of legislative modes of tort laws and perfection of such doctrine in various countries.
